WARRANTY POLICY

Warranty Against Defects
1.1. This warranty against defects (Warranty or Warranty Terms) applies only to Applicable Purchases from Wenmay Pty Ltd (ACN 082 205 525) t/a All Terrain Warriors (ABN 25 082 205 525) of 40 Central Park Drive, Yandina QLD 4561 (All Terrain Warriors, ATW or we or us).
1.2. This Warranty is to be read in conjunction with our Website Terms, Returns Policy, and Privacy Policy (Terms) and any capitalised terms not defined in this Warranty are defined in these ancillary Terms. You agree to comply with all Terms when accessing or using our Services, including this Warranty.
1.3. This Warranty applies only to Goods (as defined in our Terms) containing parts manufactured by All Terrain Warriors, including without limitation ATW Rims, ATW Parabolic Suspension, ATW Towbars, ATW Roof Racks, ATW Scrub Bars, ATW Bullbars, ATW Auxiliary Fuel Tanks, ATW Water Tanks, ATW Tray Bodies, ATW Canopies and ATW Lockers (Applicable Purchases).
1.4. If you are unsure whether the Warranty applies to your purchase, please refer to our Website which will specify whether the Warranty applies.
1.5. Where there is a manufacturer’s defect with your Applicable Purchase, you may fill out a warranty claim form in accordance with these Warranty Terms and if successful, you are entitled to an automatic repair or replacement of the Good or refund in the form of credit to our online store located at www.allterrainwarriors.com.au.
1.6. You may make a claim under this Warranty within 12 months from the date of delivery, as reflected on your invoice (Warranty Period).
1.7. During the Warranty Period, All Terrain Warriors may (at its discretion) provide you with free or discounted maintenance checks at the All Terrain Warriors workshop facility. For more information you may directly contact us.
1.8. All Terrain Warriors also sells Goods which are manufactured by third parties, including tyres, electrical components, roof top tents, awnings, recovery equipment, fridges and cooking appliances. For the avoidance of doubt, this Warranty does not apply to those Goods and any applicable warranties for third party products are governed by the terms and conditions of sale of the third party manufacturers.
2.Australian Consumer Law
2.1. Our Warranty Terms do not limit, modify or exclude any rights available to you under Schedule 2 of the Competition and Consumer Act 2010 (Cth) (Australian Consumer Law or ACL).
2.2. Our Goods and Services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the Service, you are entitled:
(a) to cancel your service contract with us; and
(b) to a refund for the unused portion, or to compensation for its reduced value.
2.3. You are also entitled to choose a refund or replacement for major failures with Goods. If a failure with the Goods or Services does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the Goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the Goods or Services.
2.4. This Warranty gives you additional protection for the specific Goods and identifies a preferred approach to resolving warranty claims which will be quickest and simplest for all parties, subject to the exclusions, terms and conditions in this Warranty.
3. Making a claim
3.1. Subject to clause 3.5, in order for you to be entitled to make a claim under this Warranty you must fill and return a completed warranty claim form (Form) within the specified warranty period for the Applicable Purchase. The Form will be available on our website, located at www.allterrainwarriors.com.au/warranty.
3.2. For warranty claims for Goods, the Form must contain the following information:
(a) your contact details, including your name, phone number and address. This information will be handled in accordance with our Privacy Policy;
(b) details regarding the original purchase, including the invoice/job number, date of purchase and date of fitment;
(c) proof of purchase in the form of a receipt or payment invoice;
(d) vehicle information including the registration, VIN number, make, model, body type, current number of kilometres travelled, estimated kilometres travelled before fitment of the applicable Product, and build date;
(e) fault location;
(f) environmental conditions when fault occurred;
(g) road surface where fault occurred;
(h) description of towing details where relevant;
(i) description of fault and aftermath; and
(j) any other details we may need to process your claim.
3.3. For suspension and tyre claims, you must provide a current weighbridge certificate within five (5) days of making your claim.
3.4. You must also provide clear, unedited photographs of the Goods and any damage to support your claim alongside the Form, including:
(a) for vehicles: a front, rear, left-hand side and right-hand side view of the whole vehicle;
(b) for faulty or damaged part(s): a front, rear, left-hand side and right-hand side view of the part(s); and
(c) for tyres:
(i) a front, left-hand side and right-hand side view of the relevant damaged area;
(ii) a view of the rim closest to the relevant damaged area;
(iii) a front, left-hand side and right-hand side view of the complete wheel assembly;
(iv) a tred depth photograph with a ruler or tred gauge as reference;
(v) a photograph of the DOT location; and
(vi) a photograph of the tyre size details e.g. 37/12.5R17; and
(d) any other relevant photographs to support your claim.
3.5. For all tyre warranty claims, you must refer to the respective manufacturer’s warranty policy and application form. Links to the warranty documents for different tyre brands are available on our Website. By clicking on the relevant link, you will be able to access and download a PDF containing the manufacturer’s warranty terms and conditions, along with the required application form. It is your responsibility to review the applicable warranty terms and submit claims in accordance with the manufacturer’s procedures.
3.6. Subject always to its obligations under the Australian Consumer Law, if, following receipt of a claim under this Warranty, All Terrain Warriors will determine within fifteen (15) business days if your claim in respect of an Applicable Purchase is valid (having regard to the terms and conditions of this Warranty), and if the Applicable Purchase can be repaired, All Terrain Warriors will within fifteen (15) business days either repair the Applicable Purchase or pay you for the cost of a repair of the Applicable Purchase, or replace the Applicable Purchase with the same or similar product or refund you the cost of a replacement, in each case depending upon what is reasonable in the circumstances and with regard to All Terrain Warriors’ statutory obligations and at no cost to you.
3.7. If you are entitled to make a claim under this Warranty, All Terrain Warriors will provide you with instructions as to how the Applicable Purchase may be returned to us at our expense. Where we are required by law to do so, we will bear the costs incurred in making a claim under this warranty including costs associated with stripping, balancing, removing, fitting, testing and/or freight.
3.8. If we provide you with either a replacement or refund, you immediately transfer ownership in the original Applicable Purchase to All Terrain Warriors.
3.9. If, following receipt of a claim under this Warranty, All Terrain Warriors or its agent determine that your Warranty claim in respect of an Applicable Purchase is invalid, All Terrain Warriors may charge you for any reasonable labour or shipping costs incurred by All Terrain Warriors or its agent in assessing your claim.
4. Exclusions
4.1. For the avoidance of any doubt, any and all warranties or conditions which are not guaranteed under the Australian Consumer Law and which are not expressly included in this Warranty as additional warranties or conditions are excluded.
4.2. Where a Good is damaged through your own misuse or where you have on-sold the Good to a third party outside of Australia, we cannot provide a refund, exchange or repair.
4.3. To the fullest extent permitted by law, this Warranty does not cover:
(a) defects, damage or malfunctions of the Applicable Purchase resulting from abnormal use or operation of the Applicable Purchase including use of the Applicable Purchase other than in its normal and customary manner, misfitment of the Applicable Purchase, wilful damage and vandalism, negligent use or fitment, accident, war, Act of God and neglect;
(b) where the Good was not installed by us: defects, damage or malfunctions of the Good caused by faulty installation or modification during installation;
(c) defects, damage or malfunctions of the Good due to your modification or purported modification of the Good;
(d) defects, damage or malfunctions due to any attempt to repair the Good on your own or with a third party;
(e) normal wear and tear of the Good;
(f) an act by you that causes the Good to become of unacceptable quality;
(g) damage caused by mould, insects, animals, vermin, foreign matter (including dust, dirt, moisture etc), or any other act or circumstance beyond All Terrain Warriors’ control;
(h) exposure to excessive heat, moisture or dampness;
(i) exposure to abnormally corrosive or harsh roads or environmental conditions;
(j) modification or other work carried out on the Applicable Purchase not approved by All Terrain Warriors, including customising or re-customising the Applicable Purchase for your use; or
(k) use or installation of the Goods by you or a third party in a manner that is inconsistent with any instructions pertaining to the Goods.
5. Termination
5.1. Without prejudice to any other remedies, All Terrain Warriors may in its absolute discretion, at any time and without notice to you terminate this Warranty. Warranty claims in relation to all Applicable Purchases made prior to termination of this Warranty will still be honoured.
5.2. To the maximum extent permitted by law, All Terrain Warriors will not be liable to you for any further loss or damage you suffer because All Terrain Warriors has exercised its rights under this clause 5 or this Warranty.
6. Amendments and correction of errors
6.1. All Terrain Warriors reserves the right to amend this Warranty from time to time as it sees fit. Any amendments or changes to this Warranty are effective from the date on which the amended terms are published except in relation to Goods purchased prior to the publication of any varied terms.
6.2. Whilst we endeavour to notify you as soon as reasonably possible of any changes to our Warranty by email or by a notice on or in the Services, it is your responsibility to keep up to date with any changes or amendments to this Warranty by checking this page, which contains our most accurate and up to date version of our Warranty.
6.3. All Terrain Warriors reserves the right to amend any errors in the Warranty amend any information, at any time without notice to you.

8. General
8.1. Waiver: Any failure or delay by All Terrain Warriors in exercising a power or right (either wholly or partially) in relation to this Warranty does not operate as a waiver or prevent All Terrain Warriors from exercising that power or right or any other power or right. We are not liable to any other party for any loss, cost or expense that may have been caused or contributed to by the failure, delay, waiver or exercise of a power or right. This clause survives termination of this Warranty.
8.2. Force majeure: If we are unable to perform in whole or in part, any obligation under this Warranty as a result of any fact, circumstance or matter beyond our control, we are relieved of that obligation to the extent and for the period that it we are unable to perform the obligation. You agree that All Terrain Warriors will not be held liable for any delay or failure in performance of any part of this Warranty.
8.3. Severability: If any part of this Warranty is determined to be by a court of competent jurisdiction to be invalid or unenforceable, that part shall be severed from the Warranty. Such invalidity does not affect the validity of the remaining provisions of this Warranty. This clause survives termination of this Warranty.
8.4. Relationship: These terms do not confer an agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship between All Terrain Warriors and you or any other party unless expressly stated otherwise.
8.5. Entire agreement: This Warranty (and all other terms and conditions and policies that are incorporated by this Warranty) and any additional policies or terms you have agreed to through use or access of our Services make up the entire agreement, and supersede all prior written and oral agreements, representations, undertakings and understandings. Where there is an inconsistency between this Warranty and any additional terms, the additional terms will prevail. This clause survives termination of this Warranty.
8.6. Jurisdiction: This Warranty is governed by the laws of Queensland, Australia. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts operating in Queensland and its appellate courts. Although the Services may be accessed throughout Australia and overseas, we make no representations or warranties that its content, or the Services, comply with the laws (including intellectual property laws) of any country outside Australia. If you access the Services from outside Australia, you do so at your own risk and are responsible for ensuring compliance with all laws in the place where you are located. This clause survives termination of this Warranty.
8.7. Export sales: All products are sold AS IS and WITH ALL FAULTS. All Terrain Warriors makes no representations or warranties of any kind, express or implied, including, without limitation, implied warranties of merchantability or fitness for a particular purpose. No warranty applies to exported goods."
